New employer obligations under immigration law change



The new Immigration Bill will require employers to check whether new employees are entitled to work in New Zealand. It is proposed that if an employer fails to check a person’s entitlement to work, and the person is not entitled to, then the employer could be prosecuted. But before this provision is enacted, consultation with employers is being sought.
 

It is important to note these employer obligation provisions are intended to seek a balance between the rights of employers to access migrant workers and employers responsibilities to employ only those with an entitlement to work.

Business NZ, EMA and the Department of Labour (DOL) want to hold meetings with employers and work closely with the implementation.
